These terms and conditions apply to the contractual relationships between NOAGE, proizvodnja in trgovina, d.o.o., Štefanova 6, 1000 Ljubljana, Slovenia (hereinafter: NOAGE) and users and consumers of products offered and traded by NOAGE and to the use of NOAGE website available at: www.noage.me (hereinafter referred to as NOAGE website) which is operated by: NOAGE.


DEFINITIONS

The following terms shall have the following meanings:  

  1. NOAGE - a private limited company established under the laws of Republic of Slovenia and registered in Slovenian business register under ID no. 8324506000, which is offering products for trade to consumers and/or business entities.

  2. Consumer – any natural person who is acting for purposes which are outside his trade, business, craft or profession.

  3. Customer – any natural person or legal entity that wishes to enter a contractual relationship with NOAGE or uses NOAGE webpage or NOAGE products or other services provided by NOAGE.

  4. Subscriber – any natural person or legal entity who registers online at www.noage.me and enters into a special subscription trade scheme within which NOAGE products are offered under special conditions defined in these terms and conditions or on NOAGE website.

  5. Personal data - any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.


02. ONLINE ORDERS

  1. By placing product descriptions with indicated purchase price NOAGE provides a binding offer to enter into a sales agreement subject to terms and conditions specified in each product description.

  2. Consumers place their order by selecting the product, its volume and quantity (by clicking the “add to cart” button). After the selection of the product is made, the consumers must choose their delivery options, enter their payment data and shipping address and confirm the order by clicking the “purchase” button. By clicking the “purchase” button the consumers order becomes legally binding.

  3. NOAGE confirms each order by sending the consumer a confirmation email to the provided address. The sales agreement between NOAGE and consumer is deemed to be concluded when the consumer receives the confirmation email from NOAGE. Consumers are solely responsible to provide correct e-mail address and to ensure that the provided e-mail address is not blocked by a SPAM filter. Any errors made during the order transaction can be identified and corrected before the final confirmation of the order which is made by clicking the “purchase” button.

  4. Prices stated on NOAGE website or provided in the order summary or at the check-out are in euro (EUR) and include VAT, where applicable. Customers will be charged in euro (EUR) even if they order from areas outside EU. NOAGE reserves the right to alter prices at any time.

  5. Delivery is provided under the conditions specified during the order transaction. Delivery costs are not included in the purchase price of the product, but are separately specified during the ordering transaction.

  6. Consumers may choose the payment methods (credit cart or Pay Pal) available by clicking the appropriate button and must enter the required data otherwise their order will not be submitted.


03. REVOCATION RIGHT

Consumers have the right to revoke their online order without specifying any reasons within 14 days from the day the consumer placed an order (14 days period includes working days, weekends and public holidays). To exercise the revocation right consumers must inform NOAGE by sending the cancellation form (available at: www.noage.me) by priority mail to the following address [NOAGE d.o.o., Stari trg 21, 1000 Ljubljana, Slovenia, EU] or if the product was delivered before the expiration of the cooling off period by returning the delivered product in the original and sealed packaging to NOAGE

  1. In cases of revocation NOAGE shall return the payment already received immediately, but no later than within 14 days after revocation notice or after returned products were delivered to NOAGE in compliance with previous article.

  2. To return the already received payment NOAGE shall use the same method of payment which was chosen by the consumer during the order transaction, unless expressly agreed otherwise with individual consumer. NOAGE can refuse the repayment until the products are returned or until evidence that the products were sent back is provided.

  3. Consumer must return such revoked products to NOAGE immediately and, in any case, at the latest within fourteen (14) days with effect from the day on which NOAGE was informed of the revocation.

  4. Consumer bears the direct costs incurred by returning the products which are subject to revocation.


04. SUBSCRIPTIONS


Customers who register for subscription options shall be entitled to a reduced price for the subscribed product(s) under special conditions and shall receive their chosen product(s) on a monthly basis either for 3 or 6 consecutive months.

  1. The three (3) months subscriptions shall ensure the subscribers approximately 20% reduction on the regular price of the product(s) for three (3) consecutive months and can not be extended automaticaly.

  2. The six (6) months subscriptions shall ensure the subscribers approximately 30% reduction on the regular price of the product(s) for six (6) consecutive months and can not be extended automaticaly,

  3. Customers can subscribe by creating a customer’s account and entering their name, address and credit card data. Subscriber’s credit card shall be charged for the subscribed products under discounted prices each month.

  4. Subscriptions are not subject to the 14 days cooling-off period. Consumers who subscribe for NOAGE product(s) are not entitled to the revocation right provided in Art. 43 of the Consumer Protection Act.

  5. In case customers wish to cancel their subscription prior to the end of the three (3) or six (6) months periods, the subscriber must fill in and sign a subscription cancellation form (available at: www.noage.me) and send it by priority mail to the following address: NOAGE d.o.o., Stari trg 21, 1000 Ljubljana, Slovenia, EU, Such notices must be sent at least 15 days prior to the end of each the subscription period. Any notice that is sent later than 15 days prior the end of the subscription period shall be taken into account in the next month of the subscription period.

  6. In all cases of premature cancellation of subscription, the Subscriber is obliged to pay to NOAGE the amount which equals the difference between regular price and reduced price (offered during subscription) of the product. Such amount is considered as appropriate liquidated damages and such amount shall not be subject to review or abatement by any court or authority.


05. CUSTOMER SUPPORT AND COMPLAINT PROCEDURE

NOAGE shall provide permanent customer support services during business hours between 9.00 and 17.00 on all working days. Customers can address their queries to NOAGE by sending a written notice to the following address: NOAGE d.o.o., Stari trg 21, 1000 Ljubljana, Slovenia, EU, or by sending an email to: info@noage.me or by calling our support services at: 00386 41 666 794. Customer support service by phone supports english and slovene language

  1. Any complaints related to online sale and claims related to the defects of delivered products must be addressed to NOAGE and send by priority mail to the following address: NOAGE d.o.o., Stari trg 21, 1000 Ljubljana, Slovenia, EU, or send by e-mail to: info@noage.me. When filing a complaint consumers must also state their address or other contact details in order to enable NOAGE to get in touch with them.

  2. Customers are entitled to claim his or her rights related to a delivered product (regardless to the revocation procedure) that are faulty or not as described or specified. In any such case customers must inform NOAGE about fault, defect or non-compliance with specifications and provide a description of such fault, defect or non-compliance with specifications.

  3. Customer who properly notified NOAGE of a fault, defect or non-compliance with specifications has the right to demand: the removal of the defect from the product, or the partial refund of the amount paid for the product in proportion to the actual fault, or the exchange of the defective product with a faultless one, or the total refund of the amount paid.

  4. Complaints filed in accordance with Art. 4.1., 4.2., 4.3. and 4.4., shall be considered within fourteen (14) days. NOAGE shall inform customers about their decision related to the submitted complaints in written form either by e-mail or regular post to the address which was provided in the complaint.


06. LIMITATION OF LIABILITY

NOAGE is not providing healing, health or medical advice, medical therapy or treatment or medical consulting and is not promoting the use of remedies, medication or other pharmaceutical products and shall not be responsible in any way for medical condition of users of NOAGE products. Users or NOAGE products are solely responsible for their health and medical condition and are advised to seek medical advice before using any of the products or recommendations based on information and data published on NOAGE website.

  1. Consumers, subscribers or any other customers shall use NOAGE products and NOAGE website responsibly and shall not abuse NOAGE in any way.

  2. NOAGE website may include third party links or provide access to third party sites and services only as a convenience. NOAGE has no influence over the content of the linked pages. In no event shall NOAGE be responsible or liable for the content of any third party sites whose URL is referred to in NOAGE website.

  3. NOAGE shall provide permanent access to NOAGE webpage and online shop, however NOAGE shall not be held liable for any interruption, obstruction, impediment or interferrence caused by third parties (like ISP providers, electricity distribution companies and similar) or circumstances or acts that are beyond NOAGE’s control such as prolonged shortage of energy supplies, fire, flood, earthquake, hurricane, typhoon, lightning, explosion, strikes, lockouts, slowdowns, epidemic, governmental, state or court order, act of public enemy, war, riots, strikes etc. (force majeur).

  4. Customers are solely responsible to provide appropriate security arrangement for their software, choice of web browser, operating system and devices including protection from viruses and other malware, protection from access from third parties etc. and to undertake all necessary activities aimed at preventing loss or disclosure of their data.


07. INTELLECTUAL PROPERTY RIGHTS

NOAGE website and its content are protected by copyright and other intellectual property rights such as copyright, designs, patents, trademarks, trade secrets, or other rights. Products, product description and other texts, sketches or pictures of the products displayed on NOAGE website are protected by intellectual property rights owned by either NOAGE or its partners. By accessing and using NOAGE website or any of its contents, customers are not granted any of the intellectual property rights vested in this website in any of the products, texts, sketches and pictures of the products displayed on this website.

  1. Unless customers acquire specific license or prior authorization from NOAGE or its contracting parties (rightholders) they are not allowed to reproduce (including but not limited to the reproduction of adapted or modified versions), sell, display or communicate to the public in any other way, or otherwise use or exploit any content of NOAGE website including all products and representations thereof in any way that violates any third-party rights.

  2. In case customers are interested in licensing or buying rights for the use of any of the objects displayed on NOAGE website, customers should send a written request to: info@noage.me.

  3. NOAGE shall try to provide accurate photographs of products presented on its website, however that shall not always be possible. Therefore all photographs of products are to be considered as symbolic, because all photographs do not guarantee the alleged features and/or quality of a particular product.

  4. NOAGE ® is an E.U. registered trademark owned by NOAGE d.o.o. and can only be used under explicit license provided by NOAGE in writing.

  5. BELINAL ® is a world-wide registered trademark owned by Abies Labs GmbH.

  6. TOTAL TRANSPARENT™ is a trade mark owned by NOAGE d.o.o., Ljubljana.


08. PRIVACY POLICY

  1. NOAGE shall process and use personal data such as (but not limited to) name, surname, e-mail, only in the case the customer discloses them by choice. Such data is necessary in order to process the ordering transaction and deliver the ordered products to customers or to process customers’ requests or complaints and shall not be used for any other purposes.

  2. Any personal data which shall be used for statistical analysis shall be anonymised.

  3. Customers who accept this will also receive newsletters.

  4. NOAGE will not share customers’ personal data with others without customers’ explicit prior consent. However this does not apply to NOAGE service partners or subcontractors which are under confidential contractual relationship with NOAGE in order to provide or handle supporting services to NOAGE (i.e. product delivery, IT support services).

  5. Responsible person for survey, processing and use of personal data is: Boris Balant, Stari trg 21, 1000 Ljubljana, Slovenia, EU. All questions regarding survey, authorisation, blocking or erasing data or other information related to the use of personal data on NOAGE website shall be addresses to the responsible person.

  6. Using a commercially reasonable level of skill and care and taking into account the nature, scope, context and purposes of processing of personal data, NOAGE shall implement appropriate technical and organisational measures to ensure a level of security which is in conformity with the generally accepted industry standards and in compliance with Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation or GDPR) and other applicable legislation to which NOAGE is subject.

  7. NOAGE uses cookies to enable certain functions for NOAGE website in particular enabling it to recognise a customer and respond appropriately. Cookies are files which are stored and saved on customer's computer or mobile device. Cookies are not used for personal identification and do not retrieve any other information from customer’s computer, pass on viruses or capture user’s e-mail address.

09. DISPUTE RESOLUTION AND GOVERNING LAW

  1. These terms and conditions and any disputes arising between NOAGE and the consumers or other customers shall be governed by and interpreted in accordance with the laws of the Republic of Slovenia and all the parties agree to submit any dispute to the courts of the Republic of Slovenia.

  1. Information about alternative dispute resolution procedure for consumers and traders are available at the Online Dispute Resolution (ODR) Platform provided by the European Commission: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show&lng=EN.

  2. In compliance with Out-of-Court Settlement of Consumer Disputes Act and Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 may 2013 on online dispute resolution for consumer disputes, NOAGE did not choose any dispute resolution body for out of court settlement procedures.


AMENDMENTS TO TERMS AND CONDITIONS

  1. NOAGE may revise these terms and conditions from time to time and the most current version will always be posted on the NOAGE website.

  2. Consumers or any other customers are responsible for checking such posts regularly. By continuing to access or use the NOAGE website after revisions become effective, consumers or other customers agree to be bound by the revised terms and conditions.

  3. Nothing in these terms and conditions affects consumers' statutory rights.
